Terms of Service

These Terms govern your use of Chofami, the Chofami marketplace, and Chofami products such as Lead Recovery.

1. Acceptance of these Terms

These Terms of Service (the “Terms”) are an agreement between you and Chofami LLC (“Chofami”, “we”, “us”). They apply when you visit chofami.com, create a Chofami account, or use any Chofami product or service (together, the “Services”).

By using the Services you agree to these Terms. If you do not agree, please do not use the Services. If you are using the Services on behalf of a business, you confirm that you are authorised to accept these Terms for that business, and “you” means that business.

2. Eligibility and accounts

You must be able to form a binding contract to use the Services, and you must use them only for lawful purposes. Chofami is designed for business use.

  • Provide reasonably accurate account information and keep it current.
  • Keep your account credentials secure, and do not share them with anyone — including anyone claiming to be Chofami support.
  • Tell us promptly at support@chofami.com if you suspect unauthorised access to your account.
  • You are responsible for activity carried out through your account, except to the extent that activity results from our own failure.

3. The Chofami Services

Chofami helps businesses discover and use AI workers — agents, workflows, skills, MCP tools, task-specific AI applications and related automation systems. The Services include the Chofami marketplace, Chofami's own first-party products (currently including Lead Recovery), and the associated website and customer application.

Chofami is an evolving product. Features may be added, changed, improved, limited or discontinued. We do not promise that any particular feature will remain available indefinitely.

4. Marketplace listings and third-party AI workers

The marketplace includes AI workers built by Chofami and AI workers built and operated by other companies or creators. A listing describes where a worker runs — for example, hosted by Chofami, hosted by its creator, installed into your own account, or provided through an external platform.

Where a worker is provided by a third party, that third party is responsible for it. Your use of it may be governed by that third party's own terms, privacy policy, pricing, availability and limitations, and you are responsible for reviewing them. Chofami does not control third-party services and does not guarantee their availability, quality, security or continued existence.

Listing a third-party worker is not an endorsement of it, and it does not mean Chofami has tested it.

5. Chofami Verification and trust labels

Chofami uses several distinct labels, and they mean different things. Curation, claiming, listing and verification are separate concepts and must not be read as equivalent:

  • Curated — Chofami independently indexed the listing from public information. It does not mean the creator was involved, and it does not mean Chofami tested it.
  • Claimed — a creator has claimed the listing. It does not mean the listing was verified.
  • Listed — the worker appears in the marketplace. It does not mean the worker was verified.
  • Chofami Verified — the worker passed a specific Chofami verification.

A verification applies only to the scope, version and checks recorded in that verification report at the time it was carried out. It is not a guarantee of security, future performance, suitability for your particular purpose, or continued accuracy. A verification may expire or require re-evaluation, and it may be updated or withdrawn.

6. Lead Recovery

Lead Recovery is a Chofami product that receives inbound leads you send to it, uses AI to assess them, sends replies and follow-ups on your behalf, and can hand a conversation to a human on your side when appropriate.

Lead Recovery is a tool that acts on the information and configuration you provide. We do not promise that any lead will receive a reply, respond, book an appointment, convert, or produce revenue. Outcomes depend on your leads, your configuration, your own follow-through and factors outside anyone's control.

Lead Recovery does not know your real calendar availability unless you supply that information through a configured integration or setting. It will not invent availability on your behalf.

7. Trials, subscriptions and billing

Paid subscriptions are currently being made available through a limited, controlled rollout. Where a trial or paid subscription is available to you, the terms in this section apply.

Free trial

  • The Lead Recovery trial runs for 14 days.
  • The trial begins only when you first activate the worker — creating an account or completing setup does not start it.
  • The trial allows up to 250 processed real leads. Test leads do not count toward that limit.
  • No payment method is required to start the trial.

Paid subscription

  • Lead Recovery is offered at USD $49 per month, which includes 250 processed real leads per paid billing period.
  • A subscription renews automatically each billing period until it is cancelled.
  • Prices may change. We will give reasonable notice of a change affecting your subscription before it takes effect.
  • You are responsible for any taxes that apply to your purchase where we are not required to collect them.

Payment processing

Payments are processed by our payment provider. Chofami does not receive or store your full card details. Your use of the payment provider's checkout and billing portal is also subject to that provider's terms.

8. Usage limits

Usage is measured in processed real leads: a genuine lead admitted into automated processing counts once. Test leads, leads rejected as spam, and leads that were never admitted into processing are not counted.

If Chofami permanently fails to process an admitted lead because of a fault on our side, we may credit that usage back to your allowance. When your allowance for a period is used up, new automated processing pauses until the next billing period; your historical data, conversations and settings remain available to you.

9. Cancellation and refunds

Cancellation

You can cancel at any time. Cancellation stops future renewals according to your subscription state at that time. Cancelling does not by itself create a refund for a charge that has already been processed, and we do not offer automatic prorated refunds for a partial billing period.

Refunds

  • Duplicate or incorrect charges — tell us and we will review it. A charge we confirm was duplicated or incorrect may be refunded.
  • Chofami technical failure — if a material technical failure on our side prevented meaningful use of a paid service, contact support. After reviewing the circumstances we may issue a refund or another appropriate remedy.
  • Valid charges — subscription charges are generally non-refundable once processed.
  • Exceptional circumstances — we review these case by case. Write to support@chofami.com.

Nothing in this section limits any rights you have under applicable law that cannot be limited by agreement.

10. Your responsibilities

You are responsible for the content and instructions you give the Services, for having the right to send us the data you send, and for how you use the outputs. You are also responsible for complying with the laws that apply to your business, including those covering marketing, electronic communications and personal information.

11. Acceptable use

You agree not to:

  • use the Services for unlawful, fraudulent or deceptive purposes;
  • attempt to gain unauthorised access to any account, system or data;
  • interfere with, overload or disrupt Chofami's infrastructure;
  • upload or distribute malware, or attempt credential theft;
  • impersonate another person or misrepresent your affiliation;
  • knowingly submit harmful or unlawful content;
  • infringe anyone's intellectual property, privacy or other rights;
  • use the Services to send messages the recipient has not agreed to receive, where consent is required.

12. Your data and third-party integrations

To do the work you ask for, products such as Lead Recovery need the data you provide or connect — for example lead details and the messages exchanged with them. You keep your data; we process it to provide the Services to you.

Chofami's handling of personal information is described separately in our Privacy Policy.

We rely on third-party providers for parts of the Services, such as hosting, email delivery, AI processing and payments. Those providers may change over time.

13. AI-generated outputs and human review

The Services use AI systems. AI can make mistakes. It can produce incomplete, inaccurate or inappropriate output, misread a message or a lead's intent, and reach conclusions that a person would not. Outputs are not guaranteed to be accurate, and they should be reviewed by a person before you rely on them for anything consequential.

The Services are not a substitute for professional advice. Do not rely on them for legal, financial, medical, accounting, tax or other regulated professional advice.

14. Intellectual property

Chofami owns the Chofami website, brand, original software and original content, subject to the rights of third parties and to the terms of any open-source components we use. These Terms do not transfer our intellectual property to you; you receive a limited, non-exclusive, non-transferable right to use the Services while these Terms are in effect.

You keep the rights you already hold in the content you submit.

15. Creator and listing content

If you submit a worker, listing or other content, you confirm you have the rights needed to do so, and you grant Chofami the permissions reasonably necessary to host, display, process, review, evaluate, verify and list that content in connection with the Services — including presenting it in the marketplace. You do not transfer ownership to us.

We may review submissions, ask for information needed to evaluate a listing, decline to publish, correct obvious presentation problems, and remove or unpublish a listing. We do not promise that any submission will be published, and publication is not an endorsement or a verification.

16. Service availability and changes

We aim to keep the Services running well, but we do not promise uninterrupted or error-free availability. Maintenance, third-party failures and factors outside our control can cause interruptions. We may change, suspend or discontinue parts of the Services, and where a change materially affects a paid subscription we will give reasonable notice.

17. Disclaimers

To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available”, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will meet your requirements, that outputs will be accurate, or that third-party workers will perform as their providers describe.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

18. Limitation of liability

To the maximum extent permitted by applicable law, Chofami will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost business opportunities or lost data arising from your use of the Services.

To the maximum extent permitted by applicable law, our total liability arising out of or relating to the Services is limited to the amount you paid Chofami for the Services in the twelve months before the event giving rise to the claim.

These limits do not apply to liability that cannot be excluded or limited under applicable law.

19. Indemnification

You agree to indemnify Chofami against third-party claims arising from your unlawful use of the Services, your breach of these Terms, or content or data you submitted that you did not have the right to submit. This does not apply to claims caused by our own acts or omissions.

20. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if these Terms are breached, if use of the Services creates a legal or security risk, or if we are required to do so by law. Where circumstances reasonably allow, we will give notice and an opportunity to resolve the issue first.

Sections that by their nature should survive termination — such as intellectual property, disclaimers, limitation of liability and governing law — continue to apply.

21. Governing law

These Terms are governed by the laws of the State of Texas, United States, together with applicable United States federal law, without regard to conflict-of-laws rules. This does not deprive you of the protection of mandatory laws that apply where you live.

22. Changes to these Terms

We may update these Terms as the Services change. When we do, we will update the effective date above, and where a change materially affects your rights or a paid subscription we will give reasonable notice. Continuing to use the Services after a change takes effect means you accept the updated Terms.
